06 cases of canceling electronic customs declaration with import-export goods of group 1

This is the featured content mentioned in Circular 56/2019/TT-BTC amending Circular 49/2015/TT-BTC dated 14/4/2015 and Circular 191/2015/TT-BTC November 24,2015.

Accordingly, when carrying out e-customs procedures for packages and goods of group 1 exported or imported via postal service, enterprises must cancel customs declarations in the following cases:

– Cases prescribed in Clause 11, Article 1 of Circular 39/2018/TT-BTC;

– Declare multiple customs declarations for the same package or goods parcel (duplicating the declaration information);

– Packages and packages of imported goods have declared customs declarations and completed destruction procedures in Vietnam according to regulations;

– Customs declarations are declared according to groups of packages and packages not in compliance with regulations after handling violations;

– Low-value customs declarations that misrepresent information are not allowed to be amended, supplemented as prescribed;

Except for cases where customs clearance or release of goods and goods has passed through customs supervision areas or has been exported;

– The consignee refuses to accept the package, the package of imported goods has registered the declaration but not yet cleared.

=> Circular 56/2019/TT-BTC takes effect from October 15, 2019.

New criteria for import of used machinery and equipment are about to take effect

This is the highlight of the Decision No. 18/2019/QD-TTg on import of used machinery, equipment and technological lines.

According to the Decision, used machinery and equipment will be permitted for import if they meet the following criteria:

– The useful life of used equipment does not exceed 10 years; as for machinery or equipment in certain specific sectors, their useful life may be more than 10 years but is restricted to 15 years or 20 years (as prescribed in Appendix I to this Decision).
(The Decision No. 18 has already elaborated more on the useful life of machinery and equipment in certain specific sectors as compared to the Circular No. 23/2015/TT-BKHCN dated November 13, 2015).
– They must be manufactured according to the following standards:
+ Vietnamese Regulations on safety, energy saving and environmental protection;
+ In case none of relevant Vietnamese Regulations is not available, used machinery and equipment must be manufactured in conformance to technical criteria of Vietnamese Standards or national standards of one of G7 member countries or South of Korea on safety, energy saving and environmental protection.

Tariff of imports and exports is revised

On February 15, 2019, the Ministry of Finance promulgated the Circular No. 09/2019/TT-BTC amending and supplementing Appendices in the Circular No. 65/2017/TT-BTC on the Tariff of exports and imports of Vietnam.

The Circular modifies certain phrases used in the Appendix I of the Tariff of Imports and Exports of Vietnam as follows:

– At the subheading 8436.10, the phrase “Machinery for preparing cattle feed” will be changed into “Machinery for preparing animal feeds”.
– At the subheading 8438.10, the phrase “Bread machinery” will be changed into “Bakery machinery”.
– At the heading 84.38 and subheading 8479.20, the phrase “vegetable fats or oils” will be changed into “fixed vegetable fats or oils”.
– At the heading 85.22, the phrase “auxiliary stuffs” will be changed into “accessories”.
– At the heading 85.39, the phrase “arc-lamps” will be changed into “arc light bulbs”; “light-emitting diode (LED) lamps” into LED bulbs”

In addition, there will be certain amendments to Appendix II regarding six general rules for explaining the classification of goods as prescribed in the Circular No. 65 in 2017.

=> The Circular No. 09/2019/TT-BTC will take effect on April 1, 2019.

Venue for submission of applications for recognition of enterprises given priority in implementation of customs procedures has changed

This is mentioned in the Circular No. 07/2019/TT-BTC amending and supplementing the Circular No. 72/2015/TT-BTC on preferential treatment in implementation of customs procedures for exports and imports of enterprises.

The Circular prescribes that enterprises that wish to be given priority must directly submit their (paper) applications for recognition of such priority to the General Department of Customs for its consideration of making its decision on recognition of priority-given enterprises.
(Current regulations prescribe that applications must be directly sent to the provincial, inter-provincial or municipal-level Departments of Customs)

Within duration of 30 days of receipt of all legally required documents, the General Department of Customs will verify and make its decision on submitted applications. In some complicated situations, such duration may be extended to 30 days at maximum.

Furthermore, additional regulations on extension of preferential treatment for priority-given enterprises have been adopted.

=> The Circular No. 07/2019/TT-BTC enters into force on January 28, 2019.

CPTPP Tariff Schedules on preferential export duties now available for use

Government has promulgated the Decree No. 57/2019/ND-CP on Tariff Schedules on Preferential Export Duties and Specially Preferential Import Duties with a view to implementing CPTPP Agreement for the period of 2019 – 2022.

Tariff Schedules on Preferential Export Duties under CPTPP Agreement are set out in Appendix I to this Decree, including:

Commodity codes, description and preferential export duty rates applied to commodity codes over periods for exports to specific member states, provided in Point a of Clause 4 of Article 4 in this Decree.
For example, export duty rates will be applied in the period of 2019 – 2022 as follows:

– United Mexican States applies duty rates specified in Appendix I:
+ From January 14, 2019 to December 31, 2019 at the column bearing the symbol “(I)”.
+ From January 1, 2020 to December 31, 2019 at the column bearing the symbol “(II)”.
+ From January 1, 2021 to December 31, 2021 at the column bearing the symbol “(III)”.
+ From January 1, 2022 to December 31, 2022 at the column bearing the symbol “(IV)”.

– Australia, Canada, Japan, New Zealand and Singapore Republic apply duty rates specified in Appendix I:
+ From January 14, 2019 to December 31, 2019 at the column bearing the symbol “(II)”.
+ From January 1, 2020 to December 31, 2020 at the column bearing the symbol “(III)”.
+ From January 1, 2021 to December 31, 2021 at the column bearing the symbol “(IV)”.
+ From January 1, 2022 to December 31, 2022 at the column bearing the symbol “(V)”.

Decision 23/2019/QD-TTg on the list of imported goods subject to customs procedures at import ports issued by the Prime Minister

Reduction in the number of goods subject to customs clearance requirements at entry checkpoints

This is the highlight of the Decision No. 23/2019/QD-TTg regarding list of imported goods subject to customs clearance requirements at entry checkpoints, promulgated in June 27, 2019.

Pursuant to this Decision, waste in the list approved by the Prime Minister is removed from the list of imported goods subject to customs clearance requirements at entry checkpoints.
Imported waste must be subject to particular regulations concerning entry checkpoints laid down in the Circular No. 01/2019/TT-BCT of the Ministry of Industry and Trade.
Upon importing goods, customs declarants have the option of carrying out customs procedures at Sub-departments of Customs at checkpoints as provided in Article 4 in this Decision or other places outside of entry checkpoints in the following cases:
– Customs procedures for clearance of equipment, machinery and other supplies imported for building plants and premises may be implemented at Customs Sub-departments at places where these plants, premises or warehouses thereof are located.
– Customs procedures for clearance of goods imported for contract manufacturing, production of other goods for domestic consumption, export and export processing may be implemented at:
+ Customs Sub-departments at places where headquarters, branch’s office or workshops are located;
+ Customs Sub-departments supervising processed or manufactured goods under the jurisdiction of Customs Departments at cities or provinces where workshops or entry checkpoints are located.
